The 12 Confirmed Earned-Wage-Access Laws, State by State

Nine states have signed an earned-wage-access bill into law. We count twelve confirmed bills across those nine states — three of them are a second or third EWA law in the same state, not twelve different states.

What "confirmed and enacted" means here

Our tracker flags every bill two ways: whether its substance is confidently about earned wage access (CONFIRMED, versus NEEDS_REVIEW for an ambiguous match), and whether the issuing legislature's own record shows it signed into law (enacted). The list below is the intersection: bills we are confident regulate EWA, and that are now law. Every item links to the legislature's own bill page, not our summary of it.

Nevada started the current wave

Nevada SB 290 was approved by the governor on 13 June 2023 — the earliest bill in our CONFIRMED set to become law. Read Nevada SB 290 on the Nevada Legislature's site.

Wisconsin followed with AB 574 on 21 March 2024, enacted as 2023 Wisconsin Act 131. Read Wisconsin AB 574. South Carolina's S 700 was signed by the governor on 21 May 2024. Read South Carolina S 700.

2025 brought five more states into the confirmed list

Arkansas HB 1517 became Act 347 on 20 March 2025. Read Arkansas HB 1517. Utah's HB 279 was signed by the governor on 26 March 2025. Read Utah HB 279. Indiana's HB 1125 became Public Law 222 on 6 May 2025. Read Indiana HB 1125. Maryland's HB 1294 was enacted as Chapter 847 on 25 May 2025, under the state constitution's provision for bills that become law without the governor's signature. Read Maryland HB 1294. Louisiana's HB 368 became Act No. 496 on 1 July 2025, also without the governor's signature. Read Louisiana HB 368.

2026 has already added three more confirmed laws — two of them in Wisconsin

Wisconsin is the only state in our confirmed set to enact more than one EWA bill: AB 930 became 2025 Wisconsin Act 133 on 27 March 2026, and AB 1025 became 2025 Wisconsin Act 199 a week later, on 3 April 2026. Read Wisconsin AB 930 and Wisconsin AB 1025. Kansas HB 2591 was approved by the governor on 9 April 2026. Read Kansas HB 2591. And Maryland added a second confirmed EWA law of its own, SB 94, approved as Chapter 170 on 28 April 2026 — making Maryland the other state with two. Read Maryland SB 94.

Nine states, not twelve

Count the states behind those twelve bills and you get nine: Nevada, Wisconsin, South Carolina, Arkansas, Utah, Indiana, Maryland, Louisiana, and Kansas. Wisconsin and Maryland each account for two of the twelve. If your compliance review is organized by state rather than by bill, nine is the number that matters for "where do I need to check my product against a signed EWA statute."

What we are not telling you

We are not telling you what any of these twelve statutes requires of your product. A bill's status — introduced, passed, signed, effective date — is metadata we can confirm from the legislature's own record. What a signed bill actually obligates you to do is a reading of the statutory text, which is your counsel's job, not a tracker's. What we can promise is that every bill above is linked to the legislature's own page for it, so whoever reads the text next is reading the primary source.
